Intellectual Property & Creative Guidelines:
Any content featured here or produced by Jack William Pierce under a freelance contract including but not limited to illustrations, graphic design, photography, videography, template assets, branding concepts, written work, digital materials and any other creative outputs is protected under UK intellectual property law.
Unless signed for the purpose of formal in-house contract or a written agreement explicitly assigns the intellectual property (IP) to a client or employer:

All creative work remains the intellectual property of JP Digital and Jack Pierce

Clients receive a licence to use the work for agreed purposes, not ownership of the underlying IP
-
No rights are transferred without a signed, written assignment of rights
-
Work maybe featured across portfolios and websites owned by Jack Pierce

Templates and designs feature a hidden watermark to identify work.
Studio Terms:
By engaging with freelance services, media or accessing content on this site, you agree to the following terms.
Ownership of Images & Creative Work:

All images, logo designs, brand marks, icons, concepts, and accompanying visual assets produced by Jack Pierce remain the intellectual property of the creator.

This includes work produced for campaigns, rebrands, or other client projects. Where the work has been completed in-house the property remains that of the employer

Final pieces of production are provided with usage licence for agreed purposes only (e.g., branding, marketing, packaging, digital channels)

Ownership transfer does not include RAW files, working files, sketches, unused concepts, exploratory work, or R&D materials unless explicitly agreed in writing
RAW Files:

All images originate as RAW files and can be evidenced to showcase the originality of photography

RAW files are not included in standard delivery
-
Delivery consists of edited, final images curated and processed by Jack Pierce to maintain creative quality, branding and consistnecy

Any request for RAW files must be agreed in writing and may incur an additional fee.
Usage Rights & Restrictions:

Clients may only use images, logos, or other assets for the purposes explicitly agreed in writing.

Clients may not edit, alter, resell, redistribute, or create derivative works from any imagery or brand asset without prior written permission.

Tagging or crediting third parties in relation to creative work without permission is strictly prohibited, as it may misrepresent authorship or collaboration.
Creative Direction:

All creative direction, styling, technical execution, and post-production decisions remain under the control of Jack Pierce unless otherwise agreed in writing.

Clients may provide guidelines or references, but final decisions on composition are made by the designer/photographer to protect creative direction unless otherwise set in the contract.
Deliverables:

Delivery includes the agreed number of final edited images, in the formats and resolutions specified in the project agreement.

Any additional edits, concepts, or expansions beyond the agreed scope are billed separately.

Timelines for delivery are outlined per project and are subject to agreement.
Payment Terms:

A deposit is required to secure bookings.

Remaining balance is due on delivery of final assets.

Late payments may incur additional fees or result in withholding of materials.
Cancellations & Rescheduling:

Cancellation policies and fees are outlined per project or booking.

Rescheduling is subject to availability.
-
Unforeseen circumstances may result in adjustment of timelines; both parties will act in good faith.
Logos & Brand Assets:

All logos, brand marks, icons, and concepts, including those produced for rebrands or campaigns, remain the intellectual property of Jack Pierce until full payment is received.

Upon payment, clients are granted a usage licence for agreed purposes only, no other use is permitted. See your licensing agreement to understand which elements are protected.

Ownership transfer does not include working files, sketches, unused concepts, or R&D materials unless agreed in writing.

Misuse, unauthorised modification, or misrepresentation of designs will be treated as a breach of creative ownership.
Model & Property Releases:

Clients are responsible for obtaining model releases and property permissions as detailed in the studio or projects contract.

Jack Pierce is not liable for limitations on usage if releases are not provided or should arise to mitigating circumstances.

When shooting on site we are covered under public liability insurance as part of the Artists Union of England and Wales.
Portfolio & Marketing Use:

Jack Pierce may use selected images, logos, or assets for portfolio, website, social media, or marketing purposes, unless a written NDA or specific restriction is agreed.

Those who claim ownership of productions wether under contract or freelance remain bound to the respect of creatives, standard practice and copyright laws of England and Wales.
*When a project is completed under an in-house employment contract:
In line with the protection of creatives, copyright laws and The Artists Union of England and Wales, I myselfJack Pierce retains the right to reference, display, and showcase the work publicly as part of his portfolio, case studies, marketing materials or professional documentation, unless a written NDA prevents this.
Given that this reflects standard UK creative industry practice and ensures accurate representation of authored work, any complaint or request for removal on this basis will not be upheld. Background assets may be included where relevant to demonstrate broader development, creative intent, and in-house contributions.
Liability:

Jack Pierce is not liable for any loss or damage resulting from equipment failure, data loss, or unforeseen circumstances. Should a project require a refund, the terms will be discussed and agreed personally on a per-project basis. Any damages, misinformation, or liability claims will be evaluated case-by-case, and Jack Pierce reserves the right to determine an appropriate resolution.
Indemnity:

Clients agree to indemnify Jack Pierce against any claims arising from unauthorised use, modification, or misrepresentation of delivered assets
Logos & Brand Assets:
All logo designs, brand marks, icons and accompanying visual assets created by Jack Pierce remain the intellectual property of the designer until full payment is received.
Upon full payment, the client is granted a usage licence for the agreed purposes (branding, marketing, packaging, digital channels, etc. Ownership transfer of a final logo does not include working files, sketches, unused concepts, or R&D materials unless explicitly agreed in writing.
Clients may not edit, alter, resell, redistribute, or create derivative versions of any logo or brand asset without written permission. Any misuse, unauthorised modification, or misrepresentation of the design will be treated as a breach of creative ownership and professional integrity.
Use of Work as Portfolio Material & NDA's:
The creative productions, imagery, designs, brand guidelines, studio work or 3D concepts created by JP Digital may be displayed on websites, social platforms, digital portfolios, printed portfolios, and other promotional or reference materials.
This includes work produced under freelance agreements and in-house roles. Where appropriate, brands may be credited to maintain clear and fair representation. However, where brands fail to supply accrediation to Jack Pierce efforts will not be wholly returned.
Unauthorised Use Clients, brands, and third parties may not:

Edit, alter, resell, redistribute, or replicate creative work without permission or attempt to diminish the efforts of or claim authorship of any creative work produced by Jack Pierce Whether in-house, freelance or under remote contract.

Where the work or deliverables may have been completed in-house, all contributions remain the intellectual property and creative direction of Jack Pierce.

Any effort to diminish or misrepresent these contributions will be regarded as a breach of creative ownership and professional integrity. Any unauthorised use may result in legal action for infringement under the Copyright Laws of England and Wales.
Service Agreements & Scope of Work:
All creative services, including design, branding, artwork, photography, OOH displays and consultancy, must be carried out according to an agreed written brief or proposal signed by both Jack William Pierce and the shared party.
The scope of work includes only the tasks, deliverables, and rounds of revisions explicitly stated in that agreement.
Any additional work requested by the client such as concepts, extended revisions, new deliverables, or changes to the final submission after approval will be deemed out of the projects scope and charged at our standard hourly or project rates approved by the Artists Union of England and Wales.
Project Timelines:
Clients are responsible for supplying accurate information, deadlines, brand assets, feedback and timely communication to avoid delays. If a client fails to keep up with communication, the confirmation of work or failing to meet any point within this terms and conditions, the client will be unable to request a refund, reduction in pricing or end contract prior to the agreed contract date.
Intellectual Property for Client Work:
Intellectual property rights in all concepts, drafts, research, preliminary artwork, and non-final materials remain the property of Half Lit Studios unless otherwise agreed in writing. Final deliverables are transferred to the client only upon full payment, at which point a licence or ownership transfer is granted according to the terms of the proposal.
Unless explicitly stated, the licence is:

Jack Pierce Mixed Media Creative/Half Lit Studios LTD. or otherwise named retains the right to showcase completed creative work, including process material, within portfolios, presentations, awards submissions, studio promotions, and case studies unless bound by a written NDA.
Confidentiality & NDA:
All client information, project details, materials, and communications are treated as confidential. Half Lit will not disclose any confidential information or share client work publicly until the project is complete and permissions are granted.
If a formal NDA is in place, both parties agree to protect confidential information during the project and after its conclusion. Exceptions apply only where disclosure is required by law or regulatory obligation. Clients must also maintain confidentiality regarding Half Lit’s processes, pricing, and any non-public information shared to complete the project.
Payment Terms for Creative Services:
A non-refundable deposit or upfront fee may be required before work begins. Larger projects may be billed in instalments aligned with project stages or deliverables. Final files and usage rights are released only once full payment has been received. Invoices must be paid within the timeframe stated.
Late payments may incur interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. If a client pauses or cancels a project, Jack Pierce may charge for all completed work up to that point, including a reasonable kill fee to cover time reserved and costs incurred.
Delivery & Turnaround Times:
All timelines are provided in good faith based on current workload and information supplied. Delivery dates may vary due to revisions, delays in client feedback, technical issues or the creative process which can at times be beyond our control.
With this statement, Jack Pierce or those involved in the creative production unless agreed otherwise are not liable for delays caused by third-party suppliers, print vendors, hosting platforms or other external services. Digital files are delivered via secure download links or email unless otherwise arranged.
Returns, Refunds & Dissatisfaction:
Creative services are bespoke, given at good will and time-based, therefore once a contract has been signed any future completed work is non-refundable. If a project is cancelled partway through, refunds may be granted only for uncompleted portions at the final discretion of Jack Pierce.

The refund may minus any non-refundable costs or time invested in the project to safeguard time and business development.

Feedback and revision cycles are used to refine work.

The number of included revisions will be outlined in the proposal; additional rounds are chargeable.

Creative dissatisfaction alone does not constitute grounds for a refund once work has been delivered in line with the agreed brief.
Warranties & Disclaimers:
Creative work is inherently subjective. While Jack Pierce will take efforts to ensure professionalism and quality, no guarantee is made that creative output will meet subjective personal tastes outside the agreed brief.
Colour accuracy, print variations, and material differences may occur due to device displays, manufacturing methods, and third-party production processes.
These variations are not considered faults unless materially defective. Digital files are delivered in standard formats; compatibility with outdated or unsupported software cannot be guaranteed.
Website Use & Online Conduct:
By accessing the Jack Pierce Digital website or others such as Half Lit.World or Half.Lit Studios customers agree not to misuse the site, upload malicious code, attempt unauthorised access, infringe copyright, or engage in prohibited activities.
All digital content, concepts, photography and design, including text, images, graphics, and layouts, is protected by copyright and may not be copied without permission. We may suspend or restrict access to the website where necessary for maintenance, security, or legal compliance.
We are not responsible for third-party links or content accessible through our website. This includes content shared via Instagram. Where inspiration may be taken, direct replication of any content is not permitted and where possible efforts will be made to ensure that branding is protected at all costs.
Cookies Policy 2025:
At present Jack Pierce oes not store personal data from the general public.
Advertising is permitted using the in-built advertising system without any personal uploads. Contracts are completed for the puporse of design, branding, web design, photography and brand development.
